BREAKING: US Senate fails to advance CLARITY Act

On Sunday, Trump agreed to unprecedented limits on his own crypto fortune to get the CLARITY Act over the line.

On Tuesday, the Senate voted it down anyway.

The procedural vote to advance crypto's market-structure bill failed 49 to 50, nowhere near the 60 it needed, and the industry's best shot at a federal rulebook stalled again.

The concession was supposed to be the breakthrough.

Republicans folded in more than 120 of the Democrats' own changes and handed enforcement to state attorneys general, away from a Justice Department that answers to Trump.

It still wasn't enough, because for the Democrats who blocked it, the problem was never just the wording.

Mark Warner said he got close on the law-enforcement and national-security pieces, then voted no over the "fundamental conflict of interest" of a president who profits from the industry his own agencies would police.

No ethics clause fixes that while Trump still holds the coins.

So the bill that was first in line when the Senate came back is now stuck behind the midterm calendar.

Thom Tillis filed a motion that could force another vote within days, but a Republican aide already calls it dead, and the House won't take it up until after November.

That throws crypto's rulebook back to where it started, with the SEC and CFTC writing rules a future administration can unwind, rather than a law that would outlast one.

Bitcoin dropped about $1,300 in ten minutes as the "no" votes stacked up, and Coinbase and Circle fell around 10%.

The industry spent the year lobbying for this, and walked away with a scorecard and a threat about the midterms. 🚀

Here’s what he posted ahead of it:

The Fed meets today, and a quarter-point hike is all but priced in, roughly 93% on the futures market.

The direction barely matters to Lepard.

His problem is that a handful of officials get to vote on what money should cost at all.

Gosplan was the Soviet agency that set the price of grain, bread and steel by decree, instead of letting a market find the number.

The one price that ripples through every mortgage, loan and asset on earth doesn’t come from buyers and sellers either.

It gets decided in a room, then announced.

Bitcoin is the committee’s opposite: a fixed 21 million cap, issuance that halves on a set schedule, no vote and no discretion.

It rhymes with the week you’ve just had.

Washington couldn’t agree on a rulebook for crypto, and it still can’t stop adjusting the price of the dollar.

One set of rules is always up for revision.

The other was written in code and never comes up for a vote.

That’s why the debasement crowd keeps stacking through a hawkish Fed. 🏛️

THE CLIMB STALLED 📈

Today we’re looking at BTC Risk, a simple way to gauge where we are in the cycle.

BTC Risk compresses years of price action into a number between 0 and 1:

  • Closer to 0 = historically cheap, good long term entry zones

  • Closer to 1 = historically hot, good long term distribution zones

It doesn’t call exact tops or bottoms. It shows you when risk-reward is tilted in your favour.

Current BTC Risk: 0.448 (two weeks ago: 0.447)

After two fortnights of climbing in near-lockstep, the read went flat.

BTC Risk sat at 0.448, a single thousandth above the 0.447 it printed two weeks ago.

The prior two updates added 0.073 and 0.074, marching the metric up alongside the price.

This one added 0.001, a dead stop.

That fits a fortnight where Bitcoin went nowhere in particular, chopping in its range instead of pushing to fresh highs.

Risk only climbs when price outruns its own history, and this fortnight it didn’t.

At 0.448 the metric is still 0.052 below the 0.5 midpoint, close enough to feel neutral but not yet there.

The gauge isn’t cooling, it’s catching its breath. 📈

House committee releases sweeping crypto tax bill ahead of Wednesday markup. The bill adds a $10 de minimis exemption for small crypto payments and new rules covering stablecoins, mining and staking.

ETH wallet exploit backfires as MEV bot captures $7.7M, Kelp freezes address. A bot known as Yoink front-ran the attacker and captured the stolen $7.7 million of rsETH before Kelp temporarily froze the address.

Standard Chartered predicts Arbitrum's ARB to rise 70-fold to $10, citing Robinhood Chain revenue. The bank expects tokenization and Robinhood Chain revenue to lift the token 70-fold by 2030, though holders have no direct claim on network fees.
